A Quick Reminder About Colorado’s Burglary Laws
Many people picture burglary as someone breaking into a house or business and stealing property. However, under Colorado law, burglary covers a broader set of circumstances.
According to C.R.S. 18-4-203, a person commits Second Degree Burglary if they knowingly break an entrance into, enter unlawfully, or remain unlawfully after entering a building or occupied structure with the intent to commit a crime inside. This crime may be against a person or against property.
This means burglary does not always involve forced entry or the theft of large amounts of property. It can apply whenever someone is unlawfully inside a structure and intends to commit any criminal offense against person or property.
Second Degree Burglary may be charged as a class 4 felony when it involves an occupied structure or a building used for a commercial business. It may be charged as a class 3 felony when it involves a dwelling.
This information is provided to help the community understand why certain cases result in burglary charges even when the circumstances differ from the traditional idea of breaking and entering.
